What is an OM hearing?
An OM hearing (OM-zitting) is a meeting with the Public Prosecutor (officier van justitie). This is NOT a court hearing with a judge. Instead, the prosecutor can impose a penalty directly through a penalty order (strafbeschikking).
When do you get an OM hearing?
- Minor offenses with maximum 6 years imprisonment
- Common crimes: shoplifting, vandalism, simple assault
- Traffic offenses: drunk driving, hit and run
