In Rotterdam, the amount of a deposit is strictly limited by law to protect tenants and buyers in this vibrant port city from abuse. For regular rental properties in neighbourhoods such as Delfshaven or Kralingen, the deposit may amount to a maximum of three months' rent (art. 7:285 BW), except in the case of special agreements. For room rentals, popular among students at Erasmus University, a limit of one month's rent applies. For the purchase of real estate, such as an apartment in Kop van Zuid, there is no fixed maximum, but reasonableness and fairness (art. 6:248 BW) determine the limit – typically around 10% of the purchase price. Excessive demands can be declared invalid by the Rotterdam district court, especially given the busy housing market. Calculate the deposit taking into account local risks such as damage from port activities or non-performance. Landlords and real estate agents must deposit the deposit with a recognised Rotterdam institution, such as the municipality or affiliated foundations via the Woonbond. Exceeding the limit may lead to repayment, fines and complaints with the Rotterdam Tenants' Interests Organisation.
