Committing fraud with benefits is a serious offence that is strictly addressed in Rotterdam. If the municipality discovers that you have provided incorrect or incomplete information in your benefit application, this can lead to the recovery of unduly received amounts and possibly criminal consequences. What Does Benefit Fraud Mean?

Benefit fraud occurs when someone deliberately provides incorrect or incomplete information to the Municipality of Rotterdam to obtain or retain benefits unduly. This is regulated in article 17 of the Participation Act, which includes the obligation to provide correct information.

Common Types of Benefit Fraud

In Rotterdam, we often see the following forms of fraud:

  • Concealing income: Not reporting work, undeclared work or other sources of income
  • Concealing assets: Not declaring savings or possessions above the permitted limit
  • Cohabitation fraud: Not reporting that you are cohabiting while presenting yourself as single
  • Address deception: Providing an incorrect residential address to receive benefits
  • Concealing stay abroad: Not reporting that you are staying outside the Netherlands for an extended period

Recovery Procedure in Rotterdam

If the Municipality of Rotterdam suspects fraud, a recovery process is initiated in accordance with the rules in the Participation Act (article 58 et seq.).

Step 1: Investigation by the Municipality

Rotterdam's social investigation unit conducts a thorough investigation. This may consist of home visits, observations, reviewing bank accounts (with permission or judicial approval) and speaking with third parties such as neighbours or employers.

Step 2: Notice of Intent to Recover

After the investigation, you will receive a written notice of intent to recover, detailing:

  • The period over which recovery takes place
  • The amount to be paid
  • The basis for the recovery
  • The opportunity to submit your response within six weeks

Step 3: Final Decision

After your response, the Municipality of Rotterdam will take a final decision. You can object to this decision with the municipality and possibly appeal to the District Court of Rotterdam, located at Wilhelminaplein 100-125.

Scope of Recovery in Case of Fraud

In case of fraud, the Municipality of Rotterdam may recover the full unduly received amount. Unlike negligence without intent, in the case of fraud there is no five-year limitation period; the municipality can recover up to ten years.

Administrative Sanctions in Rotterdam

Pursuant to article 18a of the Participation Act, the Municipality of Rotterdam may impose a fine in addition to recovery. This can amount to up to 100% of the recovered amount, with a maximum of € 25,389 (2024, adjusted annually).

Criminal Consequences

In cases of serious fraud (from approximately € 10,000 or repetition), the Municipality of Rotterdam may file a report with the Public Prosecution Service. This may lead to prosecution for fraud (article 326 Criminal Code) or forgery (article 225 Criminal Code), with possible penalties such as fines, community service or even imprisonment.
